These terms cover your purchase and use of Photism. By buying or using Photism you agree to them. If you do not agree, do not use the product, and use the refund policy if you have already bought it.
What you are buying
Photism is a Max for Live device and browser-based renderer for Ableton Live. Your purchase is a one-time payment for a personal license to use Photism. It includes free updates through the v1.x series, delivered as a new download.
Your license
You may use Photism for your own work, personal and commercial, including live performance, recorded video, and released content. You may install it on the computers you personally use.
You may not resell, rent, sublicense, or redistribute the Photism device and renderer files, or share them so others can use Photism without buying it. Photism does not lock the files down with copy protection. It is sold on trust, and that trust is the whole deal: if you find it useful, the fair thing is for each person using it to buy their own copy.
Requirements
Photism runs on macOS and Windows and requires Ableton Live Suite, or Ableton Live Standard with the Max for Live add-on, plus a reasonably modern GPU. Please confirm your setup meets these requirements before buying. The refund policy is there if it does not work for you.
Open-source components
Photism bundles third-party open-source software (including three.js, lil-gui, and FFmpeg). Each keeps its own license, and those licenses are reproduced in the THIRD-PARTY-NOTICES file included in your download. Those components are governed by their own terms, not by this license.
No warranty
Photism is provided "as is," without warranties of any kind, express or implied. We work hard to make it stable and useful, but we do not guarantee it will be uninterrupted or error-free, or that it will fit every system or use case.
Limitation of liability
To the fullest extent allowed by law, Photism and its developer are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the product. Any direct liability is limited to the amount you paid for Photism.
Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles. Nothing here removes rights you have under mandatory consumer-protection laws in your own country.
